Terms of Service

These Terms of Service ("Terms") govern your use of the VerTrek mobile app and website (together, "the Service"). By creating an account or using the Service, you agree to these Terms.

1. Who we are

VerTrek is a travel discovery and booking app. We surface available flights and hotels and facilitate bookings via our travel provider, Duffel Travel API. We are not the airline, hotel, or merchant of record for any booking.

2. Accounts

You must be at least 18 years old to create an account. You're responsible for keeping your password secure and for activity on your account. Notify us immediately if you believe your account has been compromised.

3. Bookings

When you book through the Service:

• You enter a contract directly with the airline, hotel, or other travel provider for the booking.
• VerTrek facilitates the booking and presents the provider's terms (including cancellation policy) before you confirm.
• Prices and availability are shown in real time and may change between when you start a search and when you confirm. We re-fetch the live offer at checkout; you'll see if the price has changed.
• Tickets and reservations are subject to the airline's or hotel's own terms, fare rules, and conditions of carriage.

4. Cancellations and changes

Cancellation and change policies are set by the airline or hotel, not by VerTrek. We surface the policy before booking. To cancel, use the in-app cancel flow under My Trips. Refund amounts and timing follow the provider's rules. We cannot waive provider penalties.

5. Sandbox mode

If you see a "Sandbox" banner during booking, you are using a test environment. No payment is taken and no real ticket is issued. The booking reference shown is real (from the test API) but is not a valid travel document. Live mode will be clearly indicated.

6. Pricing accuracy

We make a good-faith effort to display accurate prices. Because airline and hotel inventory changes constantly, the live price at checkout may differ from the cached price shown in search results. If a price change exceeds 10%, we will surface a warning before you confirm.

7. Acceptable use

You agree not to:

• Use the Service for any illegal purpose, including booking travel for sanctioned individuals or destinations.
• Submit false information when creating an account or booking.
• Reverse-engineer, scrape, or attempt to gain unauthorized access to the Service.
• Use the Service to harass, defraud, or harm other users.

8. Intellectual property

The VerTrek name, logo, and the app are protected by copyright, trademark, and other laws. You may not copy, modify, or distribute the Service without our permission. You retain ownership of the content you submit (e.g. passenger details) and grant us a limited license to use it to provide the Service.

9. Termination

You may delete your account at any time in the app or via our deletion page. We may suspend or terminate your account if you violate these Terms or if continued service would expose us or other users to risk. Bookings already issued by providers remain governed by those providers' terms after termination.

10. Disclaimers

The Service is provided "as is," without warranty of any kind. We do not guarantee that flights or hotels will be available at any specific price, that the Service will be uninterrupted, or that the information shown is error-free. Travel involves risk; you are responsible for visas, documentation, vaccinations, and other travel requirements.

11. Limitation of liability

To the maximum extent permitted by law, VerTrek's total liability arising out of these Terms or your use of the Service will not exceed the greater of (a) the booking fees you paid VerTrek in the 12 months before the claim, or (b) $100. VerTrek is not liable for indirect, incidental, or consequential damages, including missed connections, lost luggage, or trip cancellation by the provider.

12. Indemnification

You agree to indemnify VerTrek against any claims arising from your misuse of the Service or violation of these Terms.

13. Changes to these Terms

We may update these Terms. Material changes will trigger an in-app notice and updated "Last updated" date. Continued use of the Service after the change constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Fulton County, Georgia.
